CONDITIONS DE SERVICE

Les conditions du présent contrat (les « Conditions de Service ») régissent votre relation avec Furious Studio concernant votre utilisation des jeux, de la boutique en ligne, des sites Web et des services connexes de Furious Studio (le « Service »). L'utilisation du Service est également régie par la Politique de confidentialité de Furious Studio et d'autres politiques applicables, qui sont incorporées aux présentes par référence.
Avant d'accéder au Service et de l'utiliser, y compris avant de parcourir tout site Web de Furious Studio ou d'accéder à un jeu, vous devez accepter les présentes Conditions de Service et la Politique de confidentialité. Vous pouvez créer un compte invité pour utiliser le Service, et vous pouvez également être tenu d'enregistrer un compte sur le Service (collectivement, le « Compte »). Le Compte intègre, par exemple, le Compte de jeu et le Furious Studio ID. En enregistrant un Compte ou en utilisant de toute autre manière le Service, vous déclarez que vous avez atteint l'âge de la majorité légale dans votre pays de résidence. Dans le cas contraire, votre tuteur légal doit lire et accepter les présentes Conditions de Service.
EN INSTALLANT ET EN UTILISANT LE SERVICE OU EN Y ACCÉDANT DE TOUTE AUTRE MANIÈRE, VOUS ACCEPTEZ LES PRÉSENTES CONDITIONS DE SERVICE. SI VOUS N'ACCEPTEZ PAS LES PRÉSENTES CONDITIONS DE SERVICE, VEUILLEZ NE PAS INSTALLER, UTILISER LE SERVICE OU Y ACCÉDER DE TOUTE AUTRE MANIÈRE. L'UTILISATION DU SERVICE EST NULLE LORSQU'ELLE EST INTERDITE.
Furious Studio se réserve le droit, à sa discrétion, de modifier, d'ajouter ou de supprimer des parties des présentes Conditions de Service, de sa Politique de confidentialité et d'autres politiques Furious Studio applicables à tout moment, en publiant les conditions modifiées sur son Service. Vous serez réputé avoir accepté lesdites modifications si vous continuez à utiliser le Service. Si, à quelque moment que ce soit, vous n'acceptez pas une partie de la version en vigueur de nos Conditions de Service, de la Politique de confidentialité de Furious Studio ou d'autres politiques, règles ou codes de conduite de Furious Studio se rapportant à votre utilisation du Service, votre licence d'utilisation du Service sera immédiatement révoquée et vous devrez immédiatement cesser d'utiliser le Service.
Sous réserve de votre accord et du respect ininterrompu des présentes Conditions de Service et de toute autre politique applicable de Furious Studio, Furious Studio vous octroie une licence non exclusive, non transférable, ne pouvant pas faire l'objet d'une sous-licence, révocable et limitée, vous permettant d’accéder au Service et de l’utiliser à des fins de divertissement et à des fins non commerciales. Vous vous engagez à ne pas utiliser le Service à d'autres fins.
Les restrictions suivantes s'appliquent à l'utilisation du Service :
Informations de connexion et votre Compte
Vous devrez peut-être choisir un mot de passe pour votre Compte ou vous pouvez également utiliser d'autres identifiants pour accéder au Compte (les « Informations de Connexion »). Vous devrez vous abstenir de communiquer le Compte ou les Informations de Connexion ou de permettre à quiconque d'accéder à votre Compte ou d'accomplir toute autre chose susceptible de compromettre la sécurité de votre Compte. Si vous avez connaissance d'une infraction à la sécurité et, notamment, d'une perte, d'un vol ou d'une divulgation non autorisée des Informations de Connexion, ou si vous en soupçonnez l'existence, vous devez immédiatement en notifier Furious Studio et modifier vos Informations de Connexion. Vous êtes exclusivement responsable de la préservation de la confidentialité des Informations de Connexion et serez responsable de toutes les utilisations des Informations de Connexion, y compris les achats, que vous les ayez autorisés ou non. Vous êtes responsable de toute chose survenant par l'intermédiaire de votre Compte.
Furious Studio se réserve le droit de supprimer ou de récupérer tout nom d'utilisateur à tout moment et pour toute raison et, notamment, en cas de réclamation d'un tiers selon laquelle un nom d'utilisateur porte atteinte à ses droits.
Le Service ne permet qu'un seul Compte par jeu sur un appareil pris en charge, sauf si vous disposez de Furious Studio ID.
Limitations applicables à la licence
Toute utilisation du Service en violation des présentes Limitations applicables à la licence est strictement interdite, peut entraîner la révocation immédiate de votre licence limitée et engager votre responsabilité pour violation de la loi.
Vous vous engagez à vous abstenir, en toutes circonstances :
Furious Studio se réserve le droit de décider des comportements qui constituent, selon elle, des violations des règles d'utilisation ou qui sont par ailleurs contraires à l'intention ou à l'esprit des présentes Conditions de Service ou du Service lui-même. Furious Studio se réserve le droit de prendre de ce fait des mesures pouvant inclure la fermeture de votre Compte et l'interdiction à votre encontre d'utiliser le Service en tout ou en partie.
SANS LIMITATION DE TOUT AUTRE RECOURS, Furious Studio PEUT SANS PRÉAVIS LIMITER, SUSPENDRE, FERMER, MODIFIER OU SUPPRIMER DES COMPTES OU L'ACCÈS À TOUT OU PARTIE DES SERVICES DE Furious Studio (i) SI VOUS NE RESPECTEZ PAS, OU SI Furious Studio VOUS SOUPÇONNE DE NE PAS RESPECTER, LES PRÉSENTES CONDITIONS DE SERVICE ; OU (ii) EN CAS D'UTILISATION ILLÉGALE OU IRRÉGULIÈRE DU SERVICE, AVÉRÉE OU SOUPÇONNÉE. VOUS ÊTES SUSCEPTIBLE DE PERDRE VOTRE NOM D'UTILISATEUR ET VOTRE PERSONA DANS LE SERVICE DU FAIT DE LA FERMETURE OU DE LA LIMITATION DE VOTRE COMPTE, AINSI QUE LES AVANTAGES, PRIVILÈGES, ARTICLES VIRTUELS GAGNÉS ET ACHETÉS LIÉS A VOTRE UTILISATION DU SERVICE, ET Furious Studio N'EST AUCUNEMENT TENUE DE VOUS INDEMNISER AU TITRE DE TELLES PERTES OU DE TELS RÉSULTATS.
SANS LIMITATION DE NOS AUTRES RECOURS, NOUS POUVONS LIMITER, SUSPENDRE OU FERMER LE SERVICE ET LES COMPTES OU UNE PARTIE DE CEUX-CI, INTERDIRE L'ACCÈS A NOS JEUX ET SITES, ET À LEURS CONTENUS, SERVICES ET OUTILS, RETARDER OU RETIRER LE CONTENU HÉBERGÉ ET PRENDRE DES MESURES TECHNIQUES ET JURIDIQUES POUR EMPÊCHER LES UTILISATEURS D'ACCÉDER AU SERVICE SI NOUS ESTIMONS QU'ILS CRÉENT UN RISQUE OU D'ÉVENTUELLES RESPONSABILITÉS JURIDIQUES, EN VIOLANT LES DROITS DE PROPRIÉTÉ INTELLECTUELLE DE TIERS, OU EN AGISSANT DE MANIÈRE CONTRAIRE À LA LETTRE OU À L'ESPRIT DE NOS CONDITIONS OU POLITIQUES. EN OUTRE, NOUS POUVONS, DANS LES CIRCONSTANCES APPROPRIÉES ET À NOTRE SEULE ET ENTIÈRE DISCRÉTION, SUSPENDRE OU FERMER LES COMPTES D'UTILISATEURS SUSCEPTIBLES DE VIOLER DE MANIÈRE RÉPÉTÉE LES DROITS DE PROPRIÉTÉ INTELLECTUELLE DE TIERS.
Furious Studio SE RÉSERVE LE DROIT DE FERMER TOUT COMPTE RESTÉ INACTIF PENDANT 180 JOURS.
Furious Studio se réserve à tout moment le droit d'arrêter de proposer et/ou de prendre en charge le Service ou un jeu particulier ou une partie du Service, auquel cas votre licence d'utilisation du Service ou d'une partie de celui-ci sera automatiquement révoquée. Dans ce cas, Furious Studio ne sera pas tenue de fournir des remboursements, avantages ou autres indemnités aux utilisateurs au titre du Service interrompu. La fermeture de votre Compte peut inclure la désactivation de votre accès au Service ou à toute partie de celui-ci, y compris tout contenu soumis par vous-même ou par d'autres.
Vous pouvez fermer votre Compte à tout moment et pour toute raison en envoyant un email à l'adresse furiousbouncemobile@gmail.com et en informant Furious Studio que vous souhaitez fermer votre Compte.
Tous les droits attachés au Service (y compris, sans limitation, les jeux, titres, codes informatiques, thèmes, objets, personnages, noms des personnages, histoires, dialogues, accroches, concepts, illustrations, animations, sons, compositions musicales, effets audio-visuels, méthodes de fonctionnement, droits moraux, documentations, transcriptions de chats intégrées au jeu, informations concernant le profil des personnages, enregistrements des jeux effectués à l'aide d'un client de jeu Furious Studio et le logiciel des clients de jeu et du serveur Furious Studio) sont la propriété de Furious Studio. Furious Studio réserve l'ensemble des droits et, notamment, l'ensemble des droits de propriété intellectuelle et autres droits patrimoniaux, attachés à ses jeux et au Service.
NONOBSTANT TOUTE DISPOSITION CONTRAIRE DES PRÉSENTES, VOUS RECONNAISSEZ ET CONVENEZ QUE VOUS NE DÉTIENDREZ AUCUN DROIT DE PROPRIÉTÉ OU AUTRE DROIT LIÉ À LA PROPRIÉTÉ SUR LE COMPTE ET VOUS RECONNAISSEZ ET CONVENEZ ÉGALEMENT QUE TOUS LES DROITS ATTACHÉS AU COMPTE SONT ET DEMEURERONT LA PROPRIÉTÉ DE Furious Studio ET S'APPLIQUERONT À SON PROFIT.
Furious Studio possède, a obtenu sous licence ou détient de toute autre manière le droit d'utiliser l'ensemble du contenu qui apparaît dans le Service ou dans les jeux de Furious Studio. Nonobstant toute disposition contraire des présentes, vous convenez que vous n'avez aucun droit sur le contenu qui apparaît dans le Service et, notamment, sur les articles, contenus, fonctionnalités, marchandises, services ou devises virtuels apparaissant dans tout jeu de Furious Studio ou en provenant, qu'ils soient gagnés dans le cadre d'un jeu ou achetés à Furious Studio, ou sur tout autre attribut lié à un Compte ou stocké sur le Service.
« Contenu Utilisateur » désigne les communications, images, sons et l’ensemble des documents, données et informations que vous téléchargez ou transmettez par l’intermédiaire d’un client de jeu Furious Studio ou du Service, ou que d’autres utilisateurs téléchargent ou transmettent et, notamment, les textes des tchats. En transmettant ou soumettant tout Contenu Utilisateur dans le cadre de l’utilisation du Service, vous confirmez, déclarez et garantissez qu’une telle transmission ou soumission est (a) exacte et non confidentielle ou trompeuse ; (b) non contraire à quelque loi, restriction contractuelle ou droit d’un tiers que ce soit, et que vous avez l’autorisation de tout tiers dont les informations personnelles ou la propriété intellectuelle sont incluses dans le Contenu Utilisateur ; (c) exempte de virus, logiciel de publicité, logiciel espion, ver informatique ou autre code malveillant ; et (d) vous reconnaissez et convenez que vos informations personnelles comprises dans ledit contenu seront en toutes circonstances traitées par Furious Studio conformément à sa Politique de confidentialité.
Furious Studio n’assume aucune responsabilité au titre du comportement d’un utilisateur soumettant un Contenu Utilisateur et n’assume aucune responsabilité au titre du contrôle du Service à la recherche de contenus ou comportements inopportuns. Nous ne procédons pas et ne pouvons pas procéder à un examen ou contrôle préalable de l'ensemble du Contenu Utilisateur. Vous utilisez le Service à vos propres risques. En utilisant le Service, il se peut que vous soyez exposé à un Contenu Utilisateur revêtant un caractère choquant, indécent ou qui est de toute autre manière non conforme à vos attentes. Vous assumez l'ensemble des risques liés à l'utilisation de tout Contenu Utilisateur disponible dans le cadre du Service. A notre discrétion, nos représentants ou notre technologie peut contrôler et/ou enregistrer votre utilisation du Service ou vos communications (et, notamment, les chats) lorsque vous utilisez le Service.
En acceptant les présentes Conditions de Service, vous consentez par les présentes de manière irrévocable à un tel contrôle et à un tel enregistrement. Vous reconnaissez et convenez que vous n'avez aucune attente en matière de respect de la vie privée concernant la transmission de tout Contenu Utilisateur et, notamment, les chats ou communications vocales.
Furious Studio se réserve le droit de revoir, contrôler, interdire, éditer, supprimer tout Contenu Utilisateur (notamment, sans limitations, votre Contenu Utilisateur), d'en désactiver l'accès ou d'autrement le rendre indisponible sans préavis à tout moment et ce, avec ou sans motif. Si, à tout moment, Furious Studio choisit, à sa seule et entière discrétion, de contrôler le Service, Furious Studio n'assume néanmoins aucune responsabilité au titre du Contenu Utilisateur et aucune obligation de modification ou suppression de tout Contenu Utilisateur inopportun. Nous avons le droit, et non pas l'obligation, à notre seule et entière discrétion, de modifier, refuser de publier ou supprimer tout Contenu Utilisateur.
Le Service peut inclure divers forums, blogs et fonctions de chat par l'intermédiaire desquels vous pouvez publier du Contenu Utilisateur, y compris vos observations et commentaires sur des sujets particuliers. Furious Studio ne peut pas garantir que d'autres membres n'utiliseront pas les idées et informations que vous partagez. Par conséquent, si vous avez une idée ou une information dont vous souhaitez préserver la confidentialité et/ou dont vous ne voulez pas qu'elle soit utilisée par d'autres, abstenez-vous de la publier sur le Service. Furious Studio ne sera aucunement tenue d'évaluer ou d'utiliser toute idée ou information que vous choisissez de soumettre ou de vous dédommager au titre de celle-ci.
Vous êtes exclusivement responsable des informations que vous publiez sur le Service, par l'intermédiaire ou dans le cadre de celui-ci et que vous fournissez à d'autres personnes. Furious Studio peut rejeter, refuser de publier ou supprimer tout Contenu Utilisateur pour toute raison ou sans raison et, notamment, le Contenu Utilisateur qui, de l'avis exclusif de Furious Studio, contrevient aux présentes Conditions de Service.
Par les présentes, vous octroyez à Furious Studio une licence irrévocable, perpétuelle, transférable, entièrement payée, gratuite et mondiale (y compris le droit d'octroyer des sous-licences et de la céder à un tiers) et, relativement à votre Contenu Utilisateur, ainsi qu'à l'ensemble de œuvres modifiées ou dérivées de celui-ci dans le cadre de la fourniture du Service, y compris la commercialisation et les promotions du Service, le droit de les copier, reproduire, corriger, adapter, modifier, de créer des œuvres dérivées de ceux-ci, de les fabriquer, commercialiser, publier, distribuer, vendre, fournir sous licence, transférer, louer, transmettre, présenter publiquement, représenter publiquement, ou d'y fournir un accès électronique, de les diffuser, communiquer au public par télécommunication, de les afficher, représenter, stocker dans une mémoire informatique et de les utiliser et de les mettre en pratique, de quelque manière que ce soit. Par les présentes, vous octroyez également à Furious Studio le droit d'autoriser des tiers à exercer les droits accordés à Furious Studio aux termes des présentes Conditions de Service. Vous octroyez en outre, par les présentes, à Furious Studio le droit inconditionnel et irrévocable d'utiliser et d'exploiter votre nom, image et les autres informations ou matériels inclus dans tout Contenu Utilisateur et dans le cadre de tout Contenu Utilisateur, sans avoir à vous rémunérer. Sous réserve des dispositions légales, vous renoncez à tout droit d'attribution et/ou droit moral que vous êtes susceptible de détenir sur votre Contenu Utilisateur, que votre Contenu Utilisateur soit ou non modifié de quelque manière que ce soit. Furious Studio ne revendique aucun droit de propriété sur votre Contenu Utilisateur et aucune des dispositions des présentes Conditions de Service n'est censée limiter vos éventuels droits d'utilisation et d'exploitation de votre Contenu Utilisateur. Furious Studio n'est aucunement tenue de contrôler ou de faire respecter vos droits de propriété intellectuelle attachés à votre Contenu Utilisateur.
Vous êtes exclusivement responsable de vos relations avec d'autres utilisateurs du Service et toute autre partie avec laquelle vous entrez en relation par l'intermédiaire du Service et/ou des jeux de Furious Studio. Furious Studio se réserve le droit, sans y être tenue, d'intervenir selon toute modalité en cas de litige. Vous devrez coopérer pleinement avec Furious Studio dans le cadre des investigations relatives à toute activité illégale, frauduleuse ou inopportune et, notamment, devrez lui donner accès à toute partie de votre Compte qui sera protégée par un mot de passe.
Si un litige vous oppose à un ou plusieurs utilisateurs, vous nous dégagez de toute responsabilité (de même que nos dirigeants, administrateurs, agents, filiales, coentreprises et salariés) au titre des réclamations, demandes et dommages (réels et indirects) de tout type et de toute nature, connus et inconnus, résultant de tels litiges ou liés à ceux-ci de quelque manière que ce soit.
Dans le cadre du Service, vous pouvez acheter, avec de l'argent « réel », une licence limitée, personnelle, non transférable, ne pouvant pas faire l'objet de sous-licences et révocable vous permettant d'utiliser (a) une « monnaie virtuelle » et, notamment, des espèces ou diamants virtuels, qui sont tous destinés à être utilisés dans le cadre des jeux de Furious Studio ; (b) des articles, contenus ou fonctionnalités virtuels intégrés au jeu ; et (c) d'autres biens ou services (tous les points (a) à (c) étant collectivement désignés les « Articles virtuels »). Vous pouvez uniquement acheter des Articles virtuels auprès de nous ou de nos partenaires autorisés à travers le Service, sans aucune exception.
Vous acceptez la mise en vigueur de la convention d'achat d'Articles virtuels ou de tout autre contenu numérique avant la fin du délai de rétractation réglementaire défini par le droit en vigueur. Vous donnez votre consentement préalable et explicite pour que le contenu que vous avez acheté vous soit remis avant la fin du délai de rétractation, et perdez ainsi votre droit de rétraction légal.
Furious Studio peut gérer, réguler, contrôler, modifier ou supprimer les Articles virtuels à tout moment, avec ou sans préavis. Sous réserve de la législation applicable, Furious Studio ne pourra pas engager sa responsabilité envers vous ou un tiers en cas d'exercice de ces droits.
Le transfert d'Articles virtuels est interdit, sauf lorsque cela est expressément autorisé dans le Service. Sous réserve de ce qui est expressément autorisé dans le Service, vous devrez vous abstenir de vendre, acheter, convertir ou transférer de toute autre manière des Articles virtuels au profit de toute personne ou entité, ou de tenter l'une des actions susmentionnées et, notamment au profit de Furious Studio, d'un autre utilisateur ou d'un tiers.
TOUT ACHAT OU REPRISE D'ARTICLES VIRTUELS EFFECTUÉS À TRAVERS LE SERVICE EST FINAL ET NON REMBOURSABLE, SAUF LORSQUE LE DROIT EN VIGUEUR L'EXIGE. Veuillez vous référer à notre guide parental pour plus d'informations sur les achats effectués par des mineurs.
La mise à disposition d'Articles virtuels destinés à être utilisés dans les jeux de Furious Studio est un service fourni par Furious Studio qui débute dès l'acceptation par Furious Studio de votre achat.
Vous vous engagez à payer l'ensemble des frais et taxes applicables qui est dû par vous-même ou par toute personne utilisant un Compte enregistré en votre nom. Furious Studio peut modifier le prix des Articles virtuels proposés par l'intermédiaire du Service à tout moment. VOUS RECONNAISSEZ QUE Furious Studio N'EST PAS TENUE DE VOUS FOURNIR UN REMBOURSEMENT POUR QUELQUE RAISON QUE CE SOIT, ET QUE VOUS NE RECEVREZ AUCUNE SOMME OU AUTRE INDEMNITÉ AU TITRE DES ARTICLES VIRTUELS NON UTILISÉS LORS DE LA FERMETURE D'UN COMPTE, QU'UNE TELLE FERMETURE SOIT VOLONTAIRE OU INVOLONTAIRE.
Vous comprenez que le Service est un service évolutif. Furious Studio peut exiger que vous acceptiez des mises à jour du Service et des jeux de Furious Studio que vous avez installés sur votre appareil ou ordinateur. Vous reconnaissez et convenez que Furious Studio peut mettre à jour le Service et les jeux de Furious Studio, en vous en notifiant ou sans vous en notifier. Il se peut que vous deviez mettre à jour des logiciels tiers pour pouvoir recevoir le Service et jouer aux Jeux de Furious Studio.
SANS LIMITER LA RESPONSABILITÉ DE Furious Studio AUX TERMES DE L'ARTICLE 7 CI-DESSOUS, LE SERVICE EST FOURNI « EN L'ÉTAT » ET « TEL QUE DISPONIBLE » POUR VOTRE UTILISATION, SANS GARANTIE D'AUCUN TYPE, EXPRESSE OU IMPLICITE, ET, NOTAMMENT, SANS GARANTIE DE QUALITÉ MARCHANDE, D'ADÉQUATION À UN USAGE PARTICULIER, DE PROPRIÉTÉ, DE NON-CONTREFAÇON, ET SANS LES GARANTIES RÉSULTANT DES RELATIONS D'AFFAIRES OU DES USAGES COMMERCIAUX. Furious Studio NE GARANTIT PAS QUE VOUS SEREZ CAPABLE D'ACCÉDER AU SERVICE OU DE L'UTILISER AUX HEURES ET LIEUX DE VOTRE CHOIX ; QUE LE SERVICE SERA ININTERROMPU OU SANS ERREUR ; QUE LES DÉFAUTS SERONT CORRIGÉS ; OU QUE LE JEU OU LE SERVICE SONT EXEMPTS DE VIRUS OU D’AUTRES ÉLÉMENTS DOMMAGEABLES.
Certaines juridictions n'autorisent pas l'exclusion de certaines garanties. En conséquence, certaines des exclusions ci-dessus sont susceptibles de ne pas vous être applicables.
Furious Studio NE SERA RESPONSABLE ENVERS VOUS D'AUCUN DOMMAGE INDIRECT, ACCESSOIRE, CONSÉCUTIF OU AUTRE DOMMAGE SIMILAIRE ET, NOTAMMENT, D'AUCUNE PERTE DE RECETTES, D'AUCUN MANQUE À GAGNER, D'AUCUNE PERTE DE DONNEES OU PERTE D'EXPLOITATION OU AUTRE PERTE NON MATÉRIELLE (QUELLE QUE SOIT LA QUALIFICATION DONNÉE À CES PERTES), SE RAPPORTANT DE QUELQUE MANIÈRE QUE CE SOIT AUX PRÉSENTES CONDITIONS DE SERVICE OU AU SERVICE LUI-MEME, ET NE POURRA PAS ÊTRE TENUE DE VOUS VERSER DES DOMMAGES ET INTÉRÊTS SPECIAUX OU PUNITIFS, QUE CE SOIT SUR UN FONDEMENT CONTRACTUEL, DÉLICTUEL OU AUTRE, ET QUE Furious Studio AIT ÉTÉ INFORMÉE OU NON DE LA POSSIBILITÉ D'UN TEL DOMMAGE. LA RESPONSABILITÉ DE Furious Studio ENVERS VOUS NE POURRA EXCÉDER LE MONTANT QUE VOUS AUREZ VERSÉ À Furious Studio CONFORMÉMENT AUX PRÉSENTES CONDITIONS DE SERVICE AU COURS DES SIX (6) MOIS PRÉCÉDANT IMMÉDIATEMENT LA DATE À LAQUELLE VOUS FORMULEREZ UNE RÉCLAMATION POUR LA PREMIERE FOIS. VOUS RECONNAISSEZ ET CONVENEZ QUE LORSQUE VOUS N'AUREZ RIEN VERSÉ À Furious Studio AU COURS D'UNE TELLE PÉRIODE, VOTRE UNIQUE RECOURS (ET LA RESPONSABILITÉ EXCLUSIVE DE Furious Studio) AU TITRE DE TOUT LITIGE AVEC Furious Studio SERA DE CESSER D'UTILISER LE SERVICE ET DE FERMER VOTRE COMPTE.

Vous vous engagez à garantir, défendre et dégager Furious Studio (ainsi que nos responsables, directeurs, agents, filiales, co-entreprises et employés) de toute responsabilité au titre des réclamations, demandes, dommages ou autres pertes, y compris les honoraires d'avocat d'un montant raisonnable, dont un tiers se prévaudra et qui résulteront de votre utilisation du Service ou de toute violation par vous-même des présentes Conditions de Service. Toutefois, ce qui précède ne s'appliquera pas en cas de violation de droits non imputable à votre comportement intentionnel ou négligent.
Vous et Furious Studio reconnaissez que les procédures de règlement des litiges décrites dans le présent contrat s’appliquent à tous les litiges ou réclamations se rapportant aux présentes Conditions de Service, à la Politique de confidentialité ou au Service. Les litiges concernent des réclamations de toute nature, notamment les actions en justice, les procédures en equity ou les recours légaux. Les procédures de règlement des litiges s’appliqueront même si vous n’utilisez plus votre Compte, que vous le supprimez ou que vous cessez d’utiliser le Service. Elles s’appliquent également aux litiges nés avant la conclusion du présent contrat entre vous-même et Furious Studio.
Si vous ne résidez pas aux États-Unis et au Canada, les présentes Conditions de Service et tout litige lié à celles-ci, à la Politique de confidentialité ou au Service seront régis à tous égards par le droit français, sans tenir compte de ses dispositions en matière de conflit de lois.
Si vous résidez en dehors des États-Unis et du Canada, vous convenez que toute réclamation ou tout litige entre vous-même et Furious Studio devra être tranché exclusivement par un tribunal situé à Paris, France.
Vous convenez avec Furious Studio que si une partie des présentes Conditions de Service ou de la Politique de confidentialité de Furious Studio est jugée illégale ou inopposable, en tout ou en partie, par un tribunal compétent, ladite disposition sera, dans le pays concerné, uniquement inopposable dans la mesure d'une telle décision de nullité ou d'inopposabilité, sans affecter sa validité ou son opposabilité de toute autre manière ou dans tout autre pays que ce soit, et sans affecter les dispositions restantes des présentes conditions qui conserveront leur plein effet.

The terms of this agreement (the "Terms of Service") govern your relationship with Furious Studio regarding your use of Furious Studio's games, online store, websites, and related services (the "Service"). Your use of the Service is also governed by Furious Studio's Privacy Policy and other applicable policies, which are incorporated herein by reference.
Before accessing and using the Service, including before browsing any Furious Studio website or accessing a game, you must accept these Terms of Service and the Privacy Policy. You may create a guest account to use the Service, and you may also be required to register an account with the Service (collectively, the "Account"). The Account includes, for example, the Game Account and the Furious Studio ID. By registering an Account or otherwise using the Service, you represent that you have reached the legal majority age in your country of residence. Otherwise, your legal guardian must read and accept these Terms of Service on your behalf.
BY INSTALLING AND USING THE SERVICE OR ACCESSING IT IN ANY OTHER WAY, YOU ACCEPT THESE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.
Furious Studio reserves the right, at its discretion, to modify, add, or remove parts of these Terms of Service, its Privacy Policy, and other applicable Furious Studio policies at any time by posting the modified terms on its Service. You will be deemed to have accepted such modifications if you continue to use the Service. If at any time you do not accept any part of the then-current version of our Terms of Service, Furious Studio's Privacy Policy, or other policies, rules, or codes of conduct related to your use of the Service, your license to use the Service will be immediately revoked, and you must immediately cease using the Service.
Subject to your agreement and uninterrupted compliance with these Terms of Service and any other applicable Furious Studio policies, Furious Studio grants you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Service for entertainment and non-commercial purposes. You agree not to use the Service for any other purposes.
The following restrictions apply to the use of the Service:
Login Information and Your Account
You may need to choose a password for your Account or you can use other credentials to access the Account (the "Login Information"). You must refrain from disclosing the Account or Login Information or allowing anyone else to access your Account or do anything else that may compromise the security of your Account. If you become aware of a security breach, including but not limited to loss, theft, or unauthorized disclosure of Login Information, or if you suspect such a breach, you must immediately notify Furious Studio and change your Login Information. You are solely responsible for maintaining the confidentiality of the Login Information and will be responsible for all uses of the Login Information, whether authorized by you or not. You are responsible for anything that occurs through your Account.
Furious Studio reserves the right to delete or recover any username at any time and for any reason, including in response to a third-party claim that a username infringes upon their rights.
The Service allows only one Account per game on a supported device unless you have a Furious Studio ID.
Applicable License Limitations
Any use of the Service in violation of these Applicable License Limitations is strictly prohibited, may result in the immediate revocation of your limited license, and may subject you to legal liability.
You agree to refrain, at all times, from:
Furious Studio reserves the right to determine behaviors that it deems violations of usage rules or that are otherwise contrary to the intent or spirit of these Terms of Service or the Service itself. Furious Studio reserves the right to take actions, including but not limited to closing your Account and prohibiting you from using the Service in whole or in part.
WITHOUT LIMITING ANY OTHER REMEDIES, Furious Studio MAY WITHOUT NOTICE LIMIT, SUSPEND, CLOSE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO ALL OR PART OF Furious Studio's SERVICES (i) IF YOU FAIL TO COMPLY WITH, OR IF Furious Studio SUSPECTS YOU OF FAILING TO COMPLY WITH, THESE TERMS OF SERVICE; OR (ii) IN CASE OF ILLEGAL OR IRREGULAR USE OF THE SERVICE, ACTUAL OR SUSPECTED. YOU MAY LOSE YOUR USERNAME AND PERSONA IN THE SERVICE AS A RESULT OF ACCOUNT CLOSURE OR LIMITATION, AS WELL AS BENEFITS, PRIVILEGES, VIRTUAL ITEMS EARNED AND PURCHASED RELATED TO YOUR USE OF THE SERVICE, AND Furious Studio IS NOT LIABLE TO COMPENSATE YOU FOR SUCH LOSSES OR OUTCOMES.
WITHOUT LIMITING OUR OTHER REMEDIES, WE MAY LIMIT, SUSPEND, OR CLOSE THE SERVICE AND ACCOUNTS OR ANY PORTION THEREOF, PROHIBIT ACCESS TO OUR GAMES AND SITES, AND THEIR CONTENT, SERVICES, AND TOOLS, DELAY OR REMOVE HOSTED CONTENT, AND TAKE TECHNICAL AND LEGAL MEASURES TO PREVENT USERS FROM ACCESSING THE SERVICE IF WE BELIEVE THAT THEY CREATE A RISK OR POTENTIAL LEGAL LIABILITY, VIOLATE THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES, OR ACT CONTRARY TO THE LETTER OR SPIRIT OF OUR TERMS OR POLICIES. FURTHERMORE, WE MAY, UNDER APPROPRIATE CIRCUMSTANCES AND IN OUR SOLE DISCRETION, SUSPEND OR CLOSE USER ACCOUNTS THAT ARE REPEATEDLY VIOLATING THE INTELLECTUAL PROPERTY RIGHTS OF THIRD PARTIES.
Furious Studio RESERVES THE RIGHT TO CLOSE ANY ACCOUNT THAT HAS REMAINED INACTIVE FOR 180 DAYS.
Furious Studio reserves the right at any time to stop offering and/or supporting the Service or a particular game or part of the Service, in which case your license to use the Service or any part thereof will be automatically revoked. In such case, Furious Studio shall not be obligated to provide refunds, benefits, or other compensation to users for the discontinued Service. Closing your Account may include disabling your access to the Service or any part thereof, including any content submitted by you or others.
You may close your Account at any time and for any reason by sending an email to furiousbouncemobile@gmail.com and informing Furious Studio that you wish to close your Account.
All rights associated with the Service (including, but not limited to, games, titles, source code, themes, objects, characters, character names, stories, dialogues, taglines, concepts, illustrations, animations, sounds, musical compositions, audiovisual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, game recordings made using a Furious Studio game client, and Furious Studio's game client and server software) are the property of Furious Studio. Furious Studio reserves all rights, including all intellectual property and other proprietary rights, in and to its games and the Service.
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY Furious Studio AND APPLY FOR ITS BENEFIT.
Furious Studio owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in Furious Studio games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including virtual items, content, features, goods, services, or currency appearing or originating in any Furious Studio game, whether earned in a game or purchased from Furious Studio, or any other attributes associated with an Account or stored on the Service.
"User Content" means communications, images, sounds, and all material, data, and information that you upload or transmit through a Furious Studio game client or the Service, or that other users upload or transmit, including in-game chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent, and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions, or other third-party rights, and that you have permission from any third-party whose personal information or intellectual property is included in the User Content; (c) free of viruses, adware, spyware, worms, or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will be treated by Furious Studio in accordance with its Privacy Policy.
Furious Studio assumes no responsibility for the conduct of any user submitting User Content and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We do not, and cannot, pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you may be exposed to User Content that is offensive, indecent, or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or technology may monitor and/or record your use of the Service or your communications (including chats) when you are using the Service.
By accepting these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including chat or voice communications.
Furious Studio reserves the right to review, control, prohibit, edit, delete, or otherwise manipulate any User Content (including, without limitation, your User Content), discontinue access to it, or otherwise make it unavailable at any time, for any reason or for no reason, with or without notice, including if, in Furious Studio's sole discretion, any User Content violates these Terms of Service. We have the right, but not the obligation, at our sole discretion, to modify, refuse to post, or remove any User Content.
The Service may include various forums, blogs, and chat features through which you can post User Content, including your observations and comments on specific subjects. Furious Studio cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or do not want others to use, refrain from posting it on the Service. Furious Studio will have no obligation to evaluate or use any ideas or information you choose to submit, and will not compensate you for it.
You are solely responsible for the information that you post on the Service or provide to others while using the Service or in connection with it, and that you provide to other individuals. Furious Studio may reject, refuse to post, or delete any User Content for any or no reason, including User Content that, in the sole judgment of Furious Studio, violates these Terms of Service.
By submitting User Content through the Service, you hereby grant to Furious Studio an irrevocable, perpetual, transferable, fully paid, royalty-free, worldwide (sub-licensable through multiple tiers) license, to use, copy, reproduce, correct, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, transfer, rent, transmit, publicly display, publicly perform, or provide access electronically, broadcast, communicate to the public by telecommunication, display, perform, store in a computer memory, and use and practice, in any way, your User Content, as well as all modified and derivative works thereof, in connection with the provision of the Service, including the marketing and promotion of the Service, and the right to grant sublicenses to third parties. You also hereby grant to Furious Studio the unconditional, irrevocable right to use and exploit your name, likeness, and any other information or materials included in any User Content and in connection with any User Content, without any obligation to you. To the extent permitted by law, you waive any rights of attribution and/or any moral rights you may have in your User Content, regardless of whether your User Content is altered in any manner. Furious Studio does not claim any ownership rights in your User Content, and nothing in these Terms of Service is intended to restrict any rights you may have to use and exploit your User Content. Furious Studio is not obligated to monitor or enforce your intellectual property rights in your User Content.
You are solely responsible for your relationships with other users of the Service and any other party with whom you interact through the Service and/or Furious Studio games. Furious Studio reserves the right, without being obliged, to intervene in the event of a dispute. You shall fully cooperate with Furious Studio in connection with investigations related to any illegal, fraudulent, or inappropriate activity and, in particular, shall provide access to any part of your Account protected by a password.
If a dispute arises between you and one or more users, you release us (as well as our officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
As part of the Service, you can purchase, with "real" money, a limited, personal, non-transferable, non-sub licensable, and revocable license allowing you to use (a) "virtual currency," including virtual cash or diamonds, all intended to be used in Furious Studio games; (b) virtual items, content, or features integrated into the game; and (c) other goods or services (all points (a) to (c) collectively referred to as "Virtual Items"). You can only purchase Virtual Items from us or our authorized partners through the Service, without exception.
You agree to the implementation of the purchase agreement for Virtual Items or any other digital content before the end of the statutory withdrawal period provided by applicable law. You give your prior and explicit consent for the content you have purchased to be provided to you before the end of the withdrawal period, thus forfeiting your legal right of withdrawal.
Furious Studio may manage, regulate, control, modify, or delete Virtual Items at any time, with or without notice. Subject to applicable law, Furious Studio shall not be liable to you or any third party for exercising these rights.
The transfer of Virtual Items is prohibited unless expressly authorized in the Service. Subject to what is expressly authorized in the Service, you shall refrain from selling, buying, converting, or otherwise transferring Virtual Items to any person or entity, or attempting any of the aforementioned actions, including but not limited to Furious Studio, another user, or a third party.
ANY PURCHASE OR REDEMPTION OF VIRTUAL ITEMS MADE THROUGH THE SERVICE IS FINAL AND NON-REFUNDABLE, UNLESS REQUIRED BY APPLICABLE LAW. Please refer to our parental guide for more information on purchases made by minors.
The provision of Virtual Items intended for use in Furious Studio games is a service provided by Furious Studio that begins upon Furious Studio's acceptance of your purchase.
You agree to pay all applicable fees and taxes due by yourself or by any person using an Account registered in your name. Furious Studio may change the price of Virtual Items offered through the Service at any time. YOU ACKNOWLEDGE THAT Furious Studio IS NOT OBLIGATED TO PROVIDE YOU WITH A REFUND FOR ANY REASON WHATSOEVER, AND YOU SHALL NOT RECEIVE ANY SUM OR OTHER INDEMNITY FOR UNUSED VIRTUAL ITEMS UPON CLOSURE OF AN ACCOUNT, WHETHER SUCH CLOSURE IS VOLUNTARY OR INVOLUNTARY.
You understand that the Service is an evolving service. Furious Studio may require you to accept updates to the Service and Furious Studio games that you have installed on your device or computer. You acknowledge and agree that Furious Studio may update the Service and Furious Studio games, whether notifying you or not. You may need to update third-party software to receive the Service and play Furious Studio games.
WITHOUT LIMITING Furious Studio's LIABILITY UNDER ARTICLE 7 BELOW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. Furious Studio DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS THE SERVICE OR USE IT AT YOUR CHOSEN TIMES AND LOCATIONS; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE GAME OR SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS.
Some jurisdictions do not allow the exclusion of certain warranties. Therefore, some of the above exclusions may not apply to you.
Furious Studio SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SIMILAR DAMAGES, INCLUDING ANY LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY OR OTHER NON-PHYSICAL LOSS (REGARDLESS OF THE FORM OF ACTION, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE OR OTHERWISE, AND WHETHER OR NOT Furious Studio HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES). Furious Studio'S LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO Furious Studio UNDER THESE TERMS OF SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID Furious Studio ANY AMOUNTS IN SUCH PERIOD, YOUR SOLE AND EXCLUSIVE REMEDY (AND Furious Studio'S SOLE LIABILITY) FOR ANY DISPUTE WITH Furious Studio IS TO STOP USING THE SERVICE AND CLOSE YOUR ACCOUNT.
IN PARTICULAR, NONE OF THE PROVISIONS OF THESE TERMS OF SERVICE SHALL LIMIT THE LEGAL RIGHTS OF ANY CONSUMER OR EXCLUDE OR LIMIT ANY LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM ANY NEGLIGENCE OR FRAUD OF Furious Studio.
You agree to indemnify, defend, and hold Furious Studio (as well as our officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claims, demands, damages, or other losses, including reasonable attorneys' fees, asserted by any third party that arise from your use of the Service or your violation of these Terms of Service. However, the foregoing will not apply if the violation of rights is not attributable to your intentional or negligent behavior.
You and Furious Studio acknowledge that the dispute resolution procedures set forth in this agreement apply to all disputes or claims arising under these Terms of Service, the Privacy Policy, or the Service. Disputes include claims of any kind, including legal claims, equitable claims, or statutory claims. The dispute resolution procedures will apply even if you no longer use your Account, delete it, or stop using the Service. They also apply to disputes that arose before the agreement was entered into between you and Furious Studio.
If you do not reside in the United States and Canada, these Terms of Service and any dispute relating to them, the Privacy Policy, or the Service shall be governed in all respects by French law, without regard to its conflict of laws provisions.
If you reside outside of the United States and Canada, you agree that any claim or dispute between you and Furious Studio must be exclusively resolved by a court located in Paris, France.
You agree with Furious Studio that if any portion of these Terms of Service or Furious Studio's Privacy Policy is deemed unlawful or unenforceable in any respect by a competent court, that provision shall, to the extent of such illegality or unenforceability, be only ignored in that country, without affecting its validity or enforceability in any other manner or in any other country, and without affecting the remaining provisions of these terms, which shall remain in full force.
Furious Studio may assign or delegate these Terms of Service and/or Furious Studio's Privacy Policy, in whole or in part, to any person or entity at any time, with or without your consent. You may not assign or delegate your rights or obligations under these Terms of Service or the Privacy Policy without the prior written consent of Furious Studio, and any assignment or delegation by you without such consent shall be void.
Furious Studio may publish additional policies related to specific services, such as forums, contests, or loyalty programs. Your right to use such services is subject to these specific policies and these Terms of Service.

You acknowledge that the rights granted and obligations made under these Terms of Service to Furious Studio are of a unique and irreplaceable nature, the loss of which may result in irreparable harm to Furious Studio and cannot be replaced by monetary damages alone so that Furious Studio shall be entitled to seek an injunction or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.
You irrevocably waive all rights to seek injunctive or equitable relief or to prevent or restrict the operation of the Service or any other Furious Studio game, the exploitation of any advertising or other materials issued in connection therewith, or the exploitation of the Service or any content or other materials used or displayed through the Service and agree to limit your claims to claims for monetary damages within the limits set forth in Section 7 (if any).
Furious Studio shall not be liable for any delay or failure to perform resulting from causes reasonably beyond its control, including, but not limited to, any failure to perform hereunder due to unforeseen circumstances or causes beyond the control of Furious Studio, such as natural disasters, war, acts of terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, or shortages of transportation, fuel, energy, labor, or materials.
